My name is the only borrower of the truck loan that my ex-bf been driving.?

The registration is on my name as well. I did it because he was my bf and his credit only 425 and he really liked the truck (Yeah, i know, I learned a lot from it and would never ever ever do it again!!). He promised that he's gonna refinance it on someone elses withing 2 months after we got it and never done that. I bought it on December 2007. So, we broke up, he made late payments of course and lost his job, and rather sitting at the bar and get drunk. How can I get the truck back? He refuse to return it to me or to the dealer, but I can't afford the late payments, and I don't want make any payments for the car that I don't even want. Please help...

  2. Ask the bank about a voluntary reposession, or a refinance in your name only. If you have a lien on the truck, the registration is moot. The truck belongs to the bank.

    BTW, this is why most banks don't like doing cosigners that are not family/married.

  3. I don't think those cops know what they are talking about. The truck belongs to you, he has it, and won't give it back, from what I understand, that means he stole it. If, by your local laws, the truck is not stolen, take him to civil court. If you succeed, which you should, he will be forced to give the truck back. If the judge decides to take your side, he may make your ex pay you back and have your credit repaired. However, the judge may not do the second thing if he doesn't like the way you act or he feels that the agreement you had was not binding. Either way, you should be able to get the truck back and possibly sell it and regain at least some of your loss.

    If you want a little extra payback, consider taking him to court over the destruction of your phones (possibly criminal damaging or vandalism).

  4. Go to the police station and discuss the matter. Since it is in your name you can have it repoed, or you can make it a police matter.

  5. The most important thing is that the truck is registered in your name, so it is your truck. He has refused to return you your truck. You can file a stolen vehicle report with the police. He can be arrested since he has stolen your property. That would be my first option. Option #2 would be to go get the truck if I had a set of keys. Do you have keys? If you don't you may be able to get a set made from the dealer since you are on the loan papers and vehicle registration. Option #3 is to file a law suilt aginst him. Option #4 is to stop making payments on the truck. This will allow the truck to be repossesd. You can if you choose pay the fees to get the truck back from the loan company.
