The mortgage is not in my name just when he titled it. I need to remove it. I live in Arkansas if anyone can tell me what to do. I heard someone say something about a document you can buy at an office store called a quitclaim.

  1. Here is some news for you......in most cases, it wont matter if your name is or isnt on an asset.  By virtue of marriage, you will be liable for its debt, and will be entitled to half its value.

However, a quit claim deed is the document you need to shift the title to your husband.

  2. Quitclaim duly notorized should get your name off the title.

How debts are distributed is actually 2 fold.  First there is the settlement agreement, in which you or the courts will decide, who is obligated to which debt.

Step 2 , however is what many don't know about.  Lets say that in your settlement it was agreed that xyz credit card is his responsibility because it was used for his toys.  That's fine, but if the card was issued in both of your names, as far as the credit card company is concerned, the debt is both of your responsibility.

In this case, the mortgage is in his name, so the mortgage company will come looking to him for payments, not you.  If you and your husband agree that this is his debt, I don't think the courts will change that, and you're probably off the hook.

  3. 1. Divorce First

    2. Quit Claim second.

First guy is right- you are married it's 50% of the bills are yours too.

  4. quit claim deed.

contact your county treasurer's office or their website.  many have the form online for free.

  5. A "Quitclaim" deed is a document wherein a person gives up, or "quits" any right or title that they may have to a specific piece of real property. It needs to be signed in front of a Notary Public and then recorded in the county where the property is situated.

This will remove your name from any right to ownership of the property. I did not understand what you said about the mortgage. A quitclaim deed will not remove you from the mortgage if you are on that, and normally you cannot be removed from a mortgage unless the property is refinanced or sold.

Your state's community property rules will govern any liabilities you may or may not have as to any marital property issues. If the house was purchased by your husband before your marriage and he then added your name to the title, the house may still be his separate property. If it was purchased during your marriage with community property funds, then most likely taking your name off of the title will have no effect. The rules as to these issues vary from state to state.
