mother was not liable to pay the balance because her name was not on the cards. Is this true ?

  1. yea the credit card companies can only deal with the cardholder and not with the family of the cardholder about debt.  


  2. yes.  they will lie like h**l and say she is but if she didn't sign anything she isn'rt liable.  they can collect from his estate, if he has one since it is the obligation of the executor to ensure that the decedent's debt are paid from the decedent's assets.  if there is no estate, she needs to tell them to leave her alone and she wants no more calls from them.

  3. That is correct. His debts, not hers. His debts die with him - unless he left a will and she accepted the will (which she doesn't have to do) in which case she may be liable for his debts just the same. So that's a nice question for a lawyer, or a notary.

  4. You got it.  That is why I am able to get a credit card and not my wife, her history is terrible so there is no way she could ever re-pay my debt if anything happens... and she wont!

  5. Perhaps, but his estate IS liable for those debts.  Before his heirs inherit, they have to be satisfied.
