My neighbour is threatening to sue me as petals from my climbing Iceberg rose are falling on his path?

  2. i wouldn't have thought so, some people are so petty and i doubt you would be able to reason with him, the only thing you could do is offer to sweep up the petals,and,on no account,cut down that beautiful iceberg rose!!

  3. He can try!  I have always been told if part of your bush or tree goes over the property line, they have the right to trim it!  Unless the petals are ruining his property, I don't see that he would have a case.  Why don't you volunteer to pick them up once a week so he doesn't have too!

  5. What a burk he is. he cannot sue you for that, and if it ever goes to Court, the judge would laugh it out of court.  Falling petals are beyond your control, so tell your neighbour to sue you as you can't stop it happening. See how far he gets.

    He can cut back the rose to the boundary fence.  You are not responsible for leaves or petals that land in his garden.

  9. I have never seen so many frivolous lawsuits before in my life...it wouldnt surprise me at all that one would try to do this and I am sure there is a lawyer just crazy enough to think he could win it. Thank goodness, we depend on our judges to have good, fair sense.

  11. I dont think so but try cutting it a bit and putting up a wire fence so it dosnt go into his garden as much!!!!! it worked 4 my old  school and offer 2 go out and pick up the leaves every second day. if he still wants to sue u, he cant say u didnt try 2 do anything about it!!!!

  12. leaves, petals, and residues exuding from plants falling or dripping from plants are considered to be in common law (UK) to be a natural by-product.

    if the petals blow by natural means across the boundary line into his property then tough luck.

    unless he specifically invites you to go on to his property to clean up then stay out, the old grunt might sue you for trespass.

    incidentally the rose petals (or any other material that drops into his garden from your plants - fruit, branches) actually belong to you.

  14. It would not make it to court, he would become a laughing stock how could he prove it came from your bushes , if it were windy enough it could come from anywhere

  15. AHAHAH  of course he can't sue you.  For him to sue you you would have to had deliberetaly placed those petal on his yard with the intent of degradation of property value.

    Basically he's a d**k sucker who just wants to give you h**l.  Even if he did find some way to get to court with such a washed up claim, your defense is this:  A number of natural factors could displace the petals onto his property.  If he has a pet that has EVER been in the front yard you can countersue... saying the pet rubbed the petals and basically stole from your property.  It's absurd but so is this whole thing.  And if it's on his sidewalk?  I thought the sidewalk was community property, because I don't remember having to pay for the sidewalk when we moved into our home.  

    Don't lose sleep on this, just laugh in his face the next time, cause he doesn't have a case and he won't ever have a case.

    However, if the rose bush does have branches that are past the property line, he can just chop off however much is on his property.

My neighbors' trees drop leaves on my property all the time.  He also tries to cut my grass REALLY short.  You should clean up after your own rose bushes.  Your neighbor can be allergic to the leaves.  I am allergic to Holly bush leaves.  Be a nice person and sweep them up.  He can't sue you for anything.

  23. No he's a sad git, shame you have to live next to him. He can cut anything that goes over the fence, that's all he can do. But be watchful he doesn't poison your plant in the night!

  25. I believe he can, even though im not a lawyer. Reason being, u dont allow him to enjoy his property. Personally i love roses, thats a shame really. U better contain ur plant.
