My neighbours cocnstantly put traffic cones on the road to stop people parking, is this illegal?

we dont have residents parking and the council own the road. i am fed up with constantly searching for parking places when these people are saving them. some have even put cones out right outside my door where i live

  1. Unless they own the road or have had permission to do this i.e for a funeral, it is illegal to use cones for personal use.


  2. Report him/her to the police as the cones will be stolen from roadworks somewhere. Annoying as it is for someone to park outside your house, so long as the car is taxed etc. then there is nothing that you can do about it unless you have purchased a parking permit from the local council. I suggest that if the police will not remove the cones, gather them up, hide them from the neighbour then phone the cones hotline and tell them that they were dumped outside your house, or take them to the local council dump. You've got to be as cheeky as these people. Best of luck!

  4. You are within your rights to remove the traffic cones from the parking space and park in that space.......they have no right to the space...

    You may find your car scratched though because they will be upset that you know your rights.

  5. It is illegal to obstruct the public highway.

    By putting cones in the public highway without good reason they are committing an Obstruction. Unfortunately, if you move the cones yourself then you are leaving yourself open to being charged if they think that you have damaged one of them. This doesn't seem fair but that's the way it is.

    You are entitled to call the police to make them remove the obstruction. If they put the cones back then the police will prosecute them. That will probably stop them more effectively than if you keep moving the cones anyway.

  7. In the UK no-one has any entitlement to park on the highway except in a designated parking place.  Technically they are causing an obstruction as it must be kept clear for all to "pass and re-pass".

    Round here, there was a rash of this sort of behaviour, including the use of some stolen police no-waiting cones; the police got fed up with complaints about it and overnight one night went out with a van and collected the lot up.  Then they waited for someone to come and claim the cones, with a view to prosecuting them for obstruction or, if appropriate, theft.  No-one came.

  9. Anything stationary or place on the road is causing an unnecessary obstruction, which is an offence. The authorities do not enforce this unless they specially desigate an area no parking or restricted parking. Placing the cones is an automatic offence - but no one will take action. You are perfectly entitled to mobe them, but do not destroy or damage them, just leave them on the pavement.

  10. Just move the cones. There is no set parking places and no one can hold a spot cause they feel like it. The person(s) placing the cones don't own certain parking places. Boy, I would be angry. I would MOVE the cones and park there. You have just as much right to park there as anyone else. If they don't like it and get on ya about moving the cones, go to the council!

    If they think they can do it, they will probably call police or some authority.  Then it can be solved from there, that person would know.

    If they dont contact anyone then they know they cant do it and they are just trying to s***w ppl anyway.

    i live in a block of flats and we have our own drive and roadways on the estate, there is no designated area for people to park and yet the other day i got to my car and some person from the other flat had put a note on my car asking me to park in front of my own flats instead of theirs as it was 'inconvenient' what a nerve, as soon as i see a space there again, im going to park there. people do seem to think that they own car spaces when they do not.

  17. The roads are public and we pay Road Tax to use them.  Nobody owns the road whether it's outside their door or not.  Of course, if someone has a driveway then you don't obstruct it.

  18. I don't know of any jurisdiction that would allow this on a public roadway or street. Your neighbour is just trying to reserve a spot in front of his house. You may move them and and park your vehicle there at any time. He cannot prevent you from doing so.

  19. Yep, you can't "save" spots unless it's an event that they get approved and are personally allowed to reserve spots (the only thing that comes to mind is a funeral).  I'd turn them in asap.

  20. It's illegal what they are doing under the Road Traffic Act. Report them to the Police for obstruction and to the Local Council because they are breaking the local bylaws. They have also must have stolen them as well to get them so report them for that as well

  22. It is illegal to put cones on public road with out planning permission. You cannot put them even outside  your own door.

  24. Move the cones if you feel confrontational. Talk to them if you're on speaking terms with them. Call the police or Parking Enforcement and ask them what they think you should do, Don't make a federal case out of it, but don't be treated like a sheep either.

  26. No one has the right to park in any street.  Even if it is outside your own home.  The police could rightly get you to move your vehicle if they think it is a hazard, even though you have parked their for years.

    As your neighbour seems to think she owns the road, you will be perfectly legal to move the cones.  Let her try and answer to the police if they come . She certainly won't be phoning them.
