My nephew was hit by another driver but the other driver is excluded from the insurance. ins wont cover?

my nephew was pulling in to drive way other driver didnt stop

the insurance claims that he was excluded from the insurance what can my nephew do. they told him he can sue or ask for money. is there anything else that he can do. what type of lawyer would he need to sue. why wont the insurance cover. or why wont my nephews insurance go after that person to get something resolved. can u help i dont know who else to ask

  1. If the person driving was excluded from coverage, then there is no responsibility on the part of the insurance company. Excluded from coverage means exactly that - the insurance company was directed by the owner of the vehicle that this person will not be covered. Your nephew can sue the owner of the car, for letting an uninsured driver operate the vehicle, or he can sue the driver, for driving without insurance. This is a civil matter. As for why your nephews insurance company won't sue on his behalf, I have no idea. Maybe you should ask them.


  2. If your nephew has uninsured motorist insurance his insurance should cover it. If the other driver was excluded on the policy it was for a good reason you would need to go after the owner of the other policy for allowing an excluded driver to use the car.In the future your nephew should consider uninsured motorist coverage.

  3. I used to work for AAA and have heard of this type of thing before. They can exclude a driver on the policy due to a bad driving record or due to parents not wanting to pay the high insurance rates for young teenage drivers. With that being said though you can still go after the insurance company for the damage to your vehicle due to auto insurance covers the car not the person! What that means for you is even though that driver is excluded from the policy that only means that the drivers car is not covered for their damage to their vehicle. The damage to your vehicle should still be covered in most instances due to the owner is always responsible for ANY damage their vehicle causes. That is why insurance is required by everybody who owns a vehicle. You may have to fight a little harder but if you let them know this then you should be able to get your car repaired and any medical bills paid. Look into it I know what I'm talking about. Remember the Auto insurance is for the car not the driver. Only the party who is at fault in this matter should not get there vehicle repaired due to they chose to exclude that driver. Good Luck!

  4. If you nephew has collision coverage on his policy, he should make the claim with his company. He would have to pay his deductible. His insurance company would then attempt to collect the mony back from the other person directly. If and when they collect the money back, your nephew would be reimbursed some or all of his deductible.

    The insurance company will not cover accidents/losses resulting from an excluded driver.

    If your nephew does not have collision coverage, he could file in small claims court. If he won, there would be a judgement placed on the liable party. Good luck though on getting your money from that.

    (I am not one for going to court, because my insurance policy covers the car doing the actual damage(not the driver)...so all drivers are covered.

       As for your nephews insurance going after an individual, they don't do that.  They would be more likely to work something out between insurance companies, but you got to keep after them. to DO something.  That is what I pay insurance for.
