It is called a step parent adoption. Just talk to your attorney, he should have all the information you need to make it possible. Congratulations, by the way. I think that's awesome.

First off your sons father will have to give his permission and sign away all of his parental rights.  Best thing to do is talk to a lawyer.

go down to your local court house and ask for the necessary paperwork...

Does your son want to be adopted??  Does he not see his father anymore?  If your new husband loves your son and is going to help you raise him that's great but you don't need a piece of paper to do that.  You don't have to erase half of your sons idenity and heritage to do that.

Find a lawyer and make sure that the bio father has revoked all his rights to your son. Good luck. :)
