My next door neighbours are building decking in there garden do they need planning permission from the council

  1. Only if the decking is elevated and if the space it creates underneath exceeds a certain cubic capacity. The volume allowed depends on the location of the decking, the type of house and what extensions or outbuildings have been put up in the past. The calculations are two complicated to put down here but if it isn't elevated then planning permission would not be required.

  3. Possibly, depends on height, area covered etc. Also are they using any of you property to support the deck (including your fence), I have advised a couple who took their neighbours to court as they had built above their DPM and it was causing rising damp on their home

There may be an issue if they will be able to overlook your garden more from the deck than they can now.  Unlikelyy if it is 4-6 inches from the ground, but if it is 5 feet in the air, then possibly.  You coudl ask the council planning office, but I woudl suggest you talk to your neighbours and maybe they can screen the side near you.

  7. Not unless it is so high that it changes the view from your garden. If the fence is yours then in the event that it needed replacing or repairing the decking must not interfere with the fence. If it does and the decking needed removing to deal with the fence you could not be held accountable for the work they would have to do after your repair work.

  9. In a nutshell, no. They dont need permission to build anything in their garden as long as it does not traverse the boundaries or break building regulations (such as if they were building another house without granted planning permission.)

    You sound a lot like my neighbour...he's always snooping over the fence but never says hello or good morning to us!

    Just let them get on with it and who knows?- you could get to know them and find out they are really decent people who dont deserve a nosy neighbour!
