Question:

My nose was broke by a random guy in the apartment complex were i live in. What are my rights?

last night around midnight, the pool area ( a few feet away from my apartment) was unlocked as always, so i went in to soak my feet and talk to friends on the phone, like i usually do, when these older guys came into the pool area, with alcohol, very drunk and disorderly. they came in, pushed me into the pool, and when i got out of the pool, the bigger white male punched me in my nose, and broke it....well...not broke it, but severly damaged, i still dont know if its broken, as the pain is bearable. i will go to the doctor tomorow morning. i have missed two days from work over this insident. i called the police, and they made an assault report. i believe that the aggressors live on the property i live on, and they know were i live, because they saw me run in and out of my apartment after they attacked me. what are my rights?

  1. You can go to a judge and take out warrants


  2. You could take it to court and sue for pain and suffering.

  3. You should have gone to the hospital right away. There is a difference between a battery and a felony battery. If you could show your nose is broken, this would be considered a felony battery and the suspects could do some good time. You could also take him to civil court for time lost from work and other damages. As far as him knowing where you live, you could try and get a stay away order as a temp and go to court for a restraining order for a more permant fix. Hope this helps

  4. This is either simple assault or battery. Both are illegal, and you should pursue criminal charges and either sue for damages or get restitution.

Did the police catch the guys who did it?  Or were they gone by the time the cops got there?  If you talk to the complex manager, she might recognize them from a description.  She might not tell you who they are, though.  Also, if there were five of them and only one of you, then the guy has 4 witnesses that would probably lie for him.

    You need to figure out what you're trying to do here...are you wanting to move out of your complex and break your lease?  Do you want the people who attacked you to be evicted?  What needs to happen for you to feel safe?

    If the police didn't have a name for the person who attacked you and he was gone by the time you got there, then you couldn't have pressed charges.  The police take the report, then you have to go to the district attorney's office and press charges.  It's two separate things.

    Your apartment complex might let you move to a different unit within the complex if it's just an issue of the men knowing where you live.  I had a problem with a neighbor right after I had renewed my lease.  I told the complex management that I couldn't live near the man anymore and the next time he got physically aggressive toward my children, I was going to shoot him...and I meant it.  They let me move the next day.  Another option for you might be to move to another complex that's owned by the same company...usually they will let you do that if they won't let you out of the lease.  You want to avoid breaking the lease, if at all possible, because it's very expensive and will affect your ability to lease an apartment in the future.

    You're probably old enough to buy a shotgun for home defense.  It's something to consider...it's always better to be prepared.
