My parents and I are planning to file for bankruptcy.?

We do not share the same account or owe the same people. The bills are under their name but I help them pay for it. Do we have to file separately?

You probably have to file separately unless you are under 18 and live at home.  Otherwise it's a big jumbled mess of who owes what.

If these debts are only in your parents name and you are not listed on the accounts as joint, or as a co-signor, then you don't file for bankruptcy, they do. The 3 of you need to pull your credit reports, review what's in who's name and then contact a bankruptcy attorney and find out what you qualify for. But...as I stated, if your name is not on anything and you just give them money because they put it under their name, you don't file. They will have to file to get this all taken care of. Good Luck!

If you have no outstanding debts you will not be able to file for bankruptcy as the outstanding monies are in their name alone, even  if you said that you helped to pay for the bills, unless your name is on the creditors bill heads they will not even acknowledge that you make any contributions towards your parents bills.  They Will have to file for the Bankruptcy on their own.

I'm not sure why you would file if the debts are all in their names. If that's the case you wouldn't need to. But if for some reason you do, then yes you have to file seperately.
