My parked car's front part was smashed , please help !!!?

Hello people, please help me out.

My car was parked in a private parking area and the front part was smashed by a driver when he was backing a van. I have already gone filed a claim with his insurance company and the company has already assigned an adjuster to me and he is gonna call me today, i havent talked to him at all, i just left voice mails to call me back asap. My car's front part was smashed, rightside headlight was out of place / snatched out, grills were torn and some bolts or parts might have fallen down at the accident spot. Should i demand for repair or total my vehicle ? My classes are gonna start from Tuesday so i'm in a deep deep trouble now, i dont have any rides. I have these questions :

1. I have permit but the accident happened while the car was parked, so is there any problem for me? cuz all fault was of the other party.

2. If they provide me with a rental and i dont have the license, but my best friend/ roommate does, can we take the rental car on his driver license and he n i will use the car to go to college? is it compulsory for the rental to be on my name?

3. will the insurance company give at least some downpayment for totalling the vehicle because I really need to buy another car if i have to because i have to go college 4 days a week. so frends, u can figure out how much i need a car.

please help me out frends,,,, this was my first car accident and my car was parked !!,,, I appreciate you for any advice, thanx

  1. as long as you got his insurance details you'll be fine, sometimes people do this and just drive off.....thats when its not so good lol


  2. You can't drive if you dont have a licence, if you were parked, in a normal car park, then it would be the vans fault completley. You should get someone else to drive you, while your care is repaired. Getting the oppisite party to pay for your repairs might help but its not exactly a nice thing to do, because if it was a accident, it was a accident...

  3. First of all, you cant demand for them to either repair or total your vehicle.

    If the cost to repair meets  your states total loss threshold, then they will total out your car.  (Example, if the cost to repair is at least 70% of the value of your car, they will not fix it.)

    If the cost is less than the threshold, his company will send you a check for the cost of repairs.

    If they offer you a rental car, the rental would have to be in your name. If you do not have a license to drive, then YOU have to pay extra to list someone else on the rental agreement to drive your butt around.

    Finally, If your vehicle is considered a total loss, the company will over you the actual cash value of your vehicle. Nothing more.  They do not give you a down payment for a new car, and they do not replace your vehicle either.  You can use the money from the claim as a downpayment for a new vehicle if you want, that is up to you.

  4. first answer- insurance will cover it.  second - ask the insurance if they will cover taxi fare in stead of rental - third - no down payment - who were you insured by ?, good luck

  5. this has happened to me before... you should call your insurance company and let them know what's going on. Give them the claim number and insurance company's contact information (including the adjuster's name). They should be able to act as a liaison between you and the other insurance company to expedite the process.

    You do not decide whether the car is totaled or not; that all depends on the amount of damage compared to the value of your car. This is usually decided by the insurance company after the adjuster looks at it and estimates the cost of the damage.

    Not sure about the rental car situation... because sometimes rental companies don't allow rentals to those under 25. Ask your insurance company.

  9. Unless the damage to the car costs more then the blue book value of the car it won't get totaled out, you will only get the money for the repair of the damage.

    The rental car will most likely need to be in your name, but you should speak to the adjuster about that.  If you are under 21 you will not be able to get a rental car, so they may let you put it into someones name who is over 21.
