My parked car was totalled friday the guy has insurance and they contacted me to get my statement?

The investigator told me it could be a week before she gets the police report and can take liability for the wreck. Does that mean she won't provide me with a rental car until then or how long does she have im so confused, my insurance told me to let them handle it all but know im stuck with no vehicle and no idea whats going on can someone please tell whats going to happen next or something. By the way i live in texas does anyone know where i can find out the laws in texas on this type of thing. Also i have a copy of the police report why will it take her so long?

  1. this is all stuff you pay your insurance company for..

    they will charge your deductible for doing the work, but it will ease the weight on your shoulders.

    check with them, and if you choose not to go through your insurance, then contact the other persons insurance and ask them,,,,, Get names and extensions, very important.

  2. i was in this situation in NJ back in april.  i called them and said i needed a rental car, and they said that since no one was deemed at fault they couldn't pay for it, but i could pay for it myself and then send them a copy of the bill, and they would reimburse me.  i went through enterprise, and since you don't pay until you bring the car back, i never had a pay a penny... they billed it all to progressive.  well, there was an accounting error on enterprises' end, and i was billed for something, but progressive fixed it and reimbursed me.

    just make sure you ask them what the limits on a rental are, so you don't get anything too expensive.  usually they will pay for a car equal to or below your car.  So, if you drive a compact car, you could only get a compact car.  if you drive a huge SUV, you could get anything that costs the same or less than a huge SUV to rent.

    they're just dragging their feet... it shouldn't take them that long to get a copy of a police report.  getting the rental will make them do something because they have to pay more money.  also, call the adjuster everyday to check on you claim... that way he gets annoyed and gets things moving.

  3. This question should be asked of your insurance company.  communicate everything through YOUR insurance company.  That is what you pay them premiums for

  4. Why don't you give her a copy of the police report.  Seems odd that their waiting to accept liability when your vehicle was parked.  

    I also don't see the difference, your in the same boat whether you go through you own or theirs....either way you don't have a rental car.  You can get into one & have them reimburse you, but you best make sure they have an enforced policy first and the limits they carry.

    FYI, now a days they don't always pay for a comparable rental vehicle....they quote reasonable...so be careful.

  5. It usually takes about 30 days. I would call the other persons insurance company and inform them I needed a car and was going to rent one and would like for them to pay for the expense I find it very hard to believe that they would not agree to do this. If this fails see an attorney you would be surprised at what just a simple telephone call from an attorney would do in a case like this Good Luck
