Question:

My partner overstayed his visa by more than 28 days, who do we appeal to ?

My partner is a paraplegic, he contracted a urinary tract infection which is common in paraplegics when he was suppose to leave the country. His doctor put him on antibiotics which gave him diarrhea, he then had to be put on a different antibiotic, eventually clearing it up. He overstayed his visa by about 3 months in all. When he eventually bought another ticket and I took him to the airport immigration pulled him up on this, we did not know we were suppose to apply for a bridging visa, they gave us 1 and he had to be out of the country within the month. He is now back in the USA, can we appeal this and will he be out for 3 years or does that depend on something? We do have a Doctors letter stating why he was unable to leave the country at that time, also my partner bought a ticket to leave the country when he was suppose to but we had to cancel as too unwell to travel. We have been together for 4 years, both of us going to each others country. Thanks for any advice

  1. The trip home by plane with anti-biotics in hand would not have impacted his care. You do not have a case for over-staying his visa.

In the USA this type of visa are called fiancee visa and it is valid between the time you enter the USA and the time that you are issued you green card.

    then yall can start working on his papers from there

    you can get a lawyer and he will give all the papers for the green card
