My passport is with Dubai police.due to a legal action for an accident at my site.bt the case nevr proceeds?

Iam an Engineer Working in Dubai.. due to an accident at my site (1.5 years ago) one of the masons working in my site got severely injured (80% disability). it happened because he wore his protection belt without being buckled. and I as a site engineer gave my passport to the police, representing my company. due to some of the confusions created by the police and Dubai municipality. the investigation of the case never started till this second. and the police is having my passport. My company is not taking proper steps to get my passport back. although i gave my passport representing my company, the legal personnels in my company think a lot to let me visit my home for my holiday... this greatly hurts me.. I need some solution so that i can get my passport back, legally.. but the police is not taking any good step to finish (or even start) this case.. or is this the way how law is enforced in Dubai... also my company is not acting fair.. what should i do??? I am greatly depressed by the way they handle my case (not even prepared for an investigation) ... please give me some suggestion... (also this case being legal and my passport being withheld legally I can't get a solution from my nation's Embassy)... how can i take this to the higher authorities of Dubai government... so that the pace (literally 0 mph) of the case can be drastically increased...and it is the sole responsibility of the Dubai police for delaying this case by wrongly seeking reports from authorities who are not to give such reports... please help me....

  1. You need to talk to the local consulate. find an embassy and talk to them about diplomatic situations like this.

    Technically I think the police cannot hold your passport as evidence if you have committed no crime.

    But I would talk to a lawyer, MY own lawyer who represents ME. no one else.

I'm not sure you are from which country, but one fundamental Rule I want to make very clear to you that a Passport is the Property of the State/Country you belong to, you are only a passport holder nothing more. As far non co-operative attitude of your Local Embassy in Dubai shows that you are Indian & its only Indian Embassy Employees in almost all countries who are the most non co-operative people in the world. When your Embassy Official whom you met told you that this being a legal matter for which the Embassy cannot do any thing, then you should have told them that the issue in question is not the legal matter but the legal document i.e. your passport which is in the possession of the Police officials of Dubai & which is the property of the government of your country. Secondly no police official can withhold/impound the Passport of any individual without a prior permission/order of the competent court of the country where this police official does so. You can consult the local lawyer in Dubai who will get this issue raised in the local judicial courts & get suitable order against the police official to return your passport. How could you wait for 1.5 years for this passport to be returned back & now after such long you wakeup to get it back, all what you did till now for getting this passport back should be properly recorded along with whatever document you got as acknowledgement from the local police to keep your passport in their possession, as these facts & evidence will be required for any legal process.
