Question:

My previous company in Malaysia threaten me after I resigned, what shall I do? Please help me..

Hi everyone, please help me. I just resigned from my job in Malaysia but my Employment pass haven't cancelled yet. They ask for my passport for the cancellation of my Employment Pass and for clearing the PCB income tax (hasil). They threaten me that if I don't give my passport they will proceed to declare to Malaysia Police / Immigration / HASIL (Income Tax) that I left the company and country without clearing the employment status and EVADE Malaysia tax from the earned income.

But actually I gave them 1 month notice of my resignation,and the manager signed on my resignation letter, I also have some mails to prove that the hand-over of my task has already done.

Now I get my Employment Pass in Singapore already and started my new job. My previous employer threaten me that they will write a letter to Singapore Ministry of Manpower..I'm worried. I don't want to give my passport as I know they will create a trouble..Please help me...

  1. Contact your local embassy or consulate and request assistance; you might also talk to an attorney, but you need someone official on your side, they are trying to railroad you.


  2. If i were you i wldnt let them threaten me because i have not done anything wrong. Get an income statement from them to enable you to get clearance from the Inland Revenue dept. This is mandatory for you to do that. As long as you have done this, why wld you worry?  

  3. Whatever happens... never surrender your passport to them.

    To settle the Income tax (with PCB, Hasil might hv balance to return to u), ask for the latest EA from them and see HASIL yourself.

    Better... since you have done the proper notices and all....ask your new company lawyer to assist and see if u can counter-sue them for negligience to cancel the employment pass.
