My question is about the I-765, Employment Authorization Document?

Hello. Finally I'm in the USA with my fiance-my current visa status is K-1 (fiance visa). My visa expires at the end of September, 2008. And We (I and my fiance) are going to get married in September, before my visa expires. I can not work now-since I dont have an Employment Authorization Document yet.So, is it worth to file EAD (I-765) before we get married and if I file an EAD application as a K-1 visa holder-for how long will that be valid??? (FYI: My K-1 visa expires in September end, 08) or should I wait untill we get married and then file the EAD with my I-485???

Your fiance visa is now considered dead upon arrival here in the US because the purpose of the visa is to travel to the US to get married.The validity date in I-94 that was attached by the Immigration in your passport when you arrived here is now your new basis on how long you can legally stay here. They usually give 90 days in your I-94 and you have that period to get married. After getting married you can apply for your greencard or I-485.Presently, the fee is $1,010.00 to file for your I-485 but you can also file along with it I-765 (Employment Authorization Card) and I-131 (Advance Parole) for free. However, if you don't have any plan to file yet for I-485, you can also file only for I-765 (EAD) but the current fee is $340.00.   2. Lots of people say, it's waste of money to file I-765 while you are on K1. And they say it'd better to file it with I-485 after you get married.
