agreement regarding payment terms, so can she actually evict me and take me to court.

p.s. my house is falling apart and i can only use half of it due to renovation THEY STOPPED once we moved in, this is why rent has not been payed. She has also stated "this is not my responsibility" when asked about fixing the house.

  1. Even though you have no paper lease, you are still considered a month to month tenant.  And yes, she can give you a 3 day notice to pay or move.  She can also follow up after the 3 days are up and you havent paid the rent, by filing for eviction in court.  And without you having a court order to withhold your rent, she will win.

    You need to do one of two things.  Get your rent paid up to date or move out.  But even if you move out, she is still entitled to her rent.  If you dont pay it and she goes to court and wins, it will end up on your credit report for up to 6 yrs.  You moved in while it is still in the process of renovations, which was your first mistake.  You will also have a hard time in court proving that they are not still renovating.

    Pay the rent you owe her and then move out.  I have a feeling your rent is what is paying for the renovations each month.

  6. She has to take you to court and get a legal eviction, anyone who rents to someone knows that you have to give a 30 day notice!! If she hasnt even gone to court then she is breaking the law, Take her to court for a Constructive Eviction, because you told her about the house falling apart and she has to take care of certain stuff as required by law! Anyone who stays at a house for more than three days has to have a 30 day notice to be evicted.
