Question:

My realtor says I can't present an offer?

My realtor says I can't present an offer b/c it is too low..is that legal? Can't I present any offer I want? She said I may be insulting the seller. What does that even mean? Arent' there some instances wehre someone accepts much less than what it is listed at?

  1. i agree with the others--the realtor is supposed to present all offers. You might want to notify your real estate commissioner in your state capitol. And notify the real estate broker in your agents office. In CA the commish will deal with this realtor, letting her know of her duties.. And, of course, look for a new agent--heck, i'd have fired her on the spot. Good luck to you.  


  2. .   I bet your agent has never met the seller in person.  If they were friends for 10 years, you would know that your offer would be insulting. But your agent knows something about real estate that you do not know. That is that , after you have unsuccessfully made 3 "low" offers on houses, you will dump your agent and get another agent.  WHy would you stick with an agent who can't get you a house?

    So if you want to make low offers ( i make lots of them) you need to explain to your agent that you will not blame her when none of your offers is accepted.  You will not dump her when you get frustrated.  Now the 2 of your can act as a "team".  THen you can get out and make any offers you want.  Does your agent know that Donald Trump never worries about insulting sellers?  I promise you that Trump does not worry.

  3. This one is not working for you. She is working for the renter. Find a new realtor.

  4. The sellers are allowed to set a limit on what they are going to waste their time with looking at.   This is especially common with estate sales, where each offer means a bunch of attorneys have to put in their hour for the their principles.

    It is legal for the seller to have the agents hold low ballers.

Your REALTOR is required to present ALL offers, even if she thinks it will insult the sellers.  The ONLY time a REALTOR is not required to present an offer to a seller is if the seller has given specific written instructions to the listing agent to NOT accept any offers either below a certain price, or reflecting certain terms not acceptable to the seller.

    I've had that happen once or twice, but it's rather rare for a seller to actually put such restrictions in writing.

  6. You can present whatever you want, but they probably won't take it if it's too low. Insulting the seller would be selling much lower than their asking price. There are instances that they do, but it's rare and it depends how long the house has been on the market. If you're trying to buy a house that other people want too, don't be stingy.

  7. acermill is correct. All offers must be presented unless the seller has specifically directed the agent not to present offers below a certain price point.

    Find yourself another Realtor. (Oh, and you refer to the Realtor as "my realtor." That's true if you have an agreement with her to be your agent. However, if it's the agent of the seller, then the Realtor is representing the seller, not you.)

    And don't worry about "insulting the seller." What do you care? Unless you're an etiquette consultant.

    Sure: Offers 10%, 20%, 30%, or even more below the listed price get accepted.

    So, get yourself another Realtor. And you might tell your current one's managing broker that the agent refused to present an offer. That's a serious issue.
