My rights as a grieving mother?

Hi, My husband and I would watch my brother in laws children for him while he was at work, the mother of those children was very unhappy about it and is now trying to gain physical custody of his children. My family and I a few weeks ago lost a child and she is using this in court. She has called CPS on us after our tragidy and myself and other children have been questioned beyond belief but all claims have been proven false. I also have to go to court in a week to fight a protective order that she has placed against us all. I believe strongly that this woman is trying to benifit off of our tragidy, is there anyway to get her to leave us alone and let us heal?

  1. My heart goes out to you!!!!

Get a lawyer and show her for what she is.

Also filing false reports with CPS after you win can be grounds for civil action.

Also CPS if they get tired of her may go after her.

Please get a lawyer and get some real legal advice.

You been through enough h**l losing a child.

    God-bless you.

  2. Do everything that the others on here have suggested, sue for def. of char., sue for mental anguish, and let everything ride for a while and then call an old friend up to take care of things.  Maybe someone from Texas...they'll never suspect a thing.   Lub u.

  3. Wow, that is really horrible, I wish people her could be charged for even atempting to profit from a death.  Get as much evidence as possible, do you have a lawyer?  Keep all documentation about the claims being proven flase, this will be very important.  Also, bring any documentation to prove that she is after money.  Sounds like you should hire a Private Investigator to gather some evidence for you, she needs to get charged.

  4. That's horrible.  When you go to court for the protective order, bring all the paperwork from child protective services--dismissing your case.  If you can get any and all witnesses to go with you, (it will be a closed court room and you only have this one chance to prove she is nuts.)  Any police records, text or email messages, bring your brother in law.  If she has said or done anything to your kids, have them write it on paper, they won't be able to go inside.  Let the judge know what's going on and you want her to stop harassing you.  Maybe you could get it reversed.  Good Luck.
