Question:

My roof is leaking is my landlord liable?

Does anyone know the laws in massachusetts on weather or not a landlord who refuses to fix a leaky ceiling can be held liable. It has rained a lot in mass this year and so far i have woken up more than 3 times wet because my ceiling is leaking from all the rain, he refuses to re finish the roof he just try's to tar it and he is not doing a great job.

OK,THERES A COUPLE OF THINGS YOU CAN DO,AS FAR AS HIM BEING LIABLE FOR YOUR BELONGINGS,NO,HES NOT,THATS WHAT RENTERS INS. IS FOR.

   BUT YOU CAN HOLD THE RENT UNTIL HE REPAIRS THE ROOF,BUT ONLY IF YOU PUT IT IN A  ESCROW ACCT. EACH MO. AND SHOW ITS THERE.BUT BEFORE YOU GO THAT FAR ,TELL HIM WHAT YOUR INTENTIONS ARE. AS FAR AS THE MOLD GOS,IF THERE IS A CLEAR&PRESENT DANGER TO YOU FROM THE MOLD,YOU CAN HOLD HIM LIABLE FOR THAT,ANY SICKNESS,DOCTOR VISITS,PERSCRIPTIONS,TREATMENTS,ECT.ECT.... LOOK INTO THE FAIR HOUSING ACT,I THINK YOU CAN ALSO GET HIM THERE TOO.MAKE SURE YOU DOCUMENT EVERYTHING YOU DO & SAY.

     ALSO ASK HIM IF HE WOULD PREFER YOU TO HAVE IT REPAIRED AND DEDUCT IT FROM THE RENT,BET HE WONT,BUT THE THING IS TO OFFER ALL RESOLUTIONS YOU CAN,THEN IF HE STILL DOESN'T DO ANYTHING ,TAKE HIM TO SMALL CLAIMS COURT.YOU WILL WIN. JUST REMEMBER,,

Please pick up the book for your area, Renters Rights.  I wanted to include a website for you, but that really depends on where you live.  Just put renters rights in the search bar and include your city.

As always keep a good paper trail between you and the landlord, that is always the key thing when in a dispute.  And yes I do believe he is liable.  Good luck to you  :)

take some pictures of it and tell them you cant sleep and then say your not going to pay him until he fixes it
