My roommate has been living with me for 3 weeks now and I have still not received any money from her!?

She moved in and she was supposed to give me money for the security deposit and half months rent. She did, but the checks bounced, they came back as account closed. I was furious, so I told her I need her to give me only cash or money orders. She told me some lie that her cousin from Maryland is going to drive up here to give her the money on Saturday. I have been asking her about it, like where is her cousin, what is the status, she keeps telling me some story, now it is Monday and still no money, so I told her that she HAS 24 HOURS FROM 9AM TODAY TO GIVE ME WHAT IS DUE or her lease would be voided and she would need to leave the premises or I would file fraudulant charges against the bounced checks.

Was I right for saying this. Please help me, I am still confused

  1. Since she has not paid you dollar one.  There is no consideration on her part.  The lease is not enforce.  If you want to move her out you can.  On the other hand if you want your money you will have to consider the consideration you have given her (living with you for 3 weeks).

    Paper is paper Non-compete, Contract this contract that.  They have no value unless there is consideration.  Consideration is usually money, but can be other tangible compensation.  If there is no consideration a contract is not enforceable.

    You also have the bounced checks - depending on how much they are for they are either misdemeanors, or grand larceny.  You cannot just write checks for the fun of it.

    In any case - you need to get RID of this person.  Roommates who are not responsible - typically want roommates - so they can stick someone else with their bills.  You should never lend a roommate money.  You either get rid of her now, and go through the drama to cut your losses, or later when your losses are greater.


  2. Well you can say all that but legally, you have to give her more notice.  Depending on what state, there are certain legal requirements to evict.  Things like serving various pay or quit notices and getting a court order.

    Go ahead and file fraud charges on the bounced checks.  If she goes to jail, you'll be rid of her.

  3. You are the landlord, so you can decide how long she has to pay each month. What does the contract say? That information should be in a contract before someone moves in so in case there are problems you have recourse. If you do not have any specific in the contract then, I would give her the 24 hours you requested and evict her if you do not get any money.
