Question:

My roommate is late on this month's rent by 6 days. What should I do?

How long should I wait for the rent? If I were to kick her out I'd be out 1k. Also, I already paid the rent but I didn't tell her that. Her name is not on the lease.

  1. The person who said "or she doesnt stay the night" is wrong. By law, you have to give a person 30 days time to get out. You cant just kick someone out on the street, even if they dont pay rent. What can you do? Ask her for the money now and if see what her excuse is and if its reasonable or if shes going to get it soon. Dont drag it out too long and give her the ultimatum now. Tell her now, that if she doesnt come out with the money, then she has to leave within 30 days. The clock starts ticking now even though she may pay you next week.


  2. She gives you the money today, or she can't stay the night. This will just get worse and worse unless you put a stop to it now.

    "Give him a WRITTEN 30 day notice to vacate. He does not have to sign anything.  Although there is another notice titled  3 day notice to pay rent or quit, they are more difficult to use and don't always stand up in court. Judges don't like them.

    Talk to your landlord and have him sign the 30 day notice also (some will, some won't). Tell the landlord that you need to get your roommate out ASAP.  He might have other options for you.

    Also tell your roommate that you do NOT want to go thru an eviction service because then his name would appear in the flake database. It would ruin his credit rating and he would have major problems finding housing anywhere. An eviction on your credit report is a red flag to landlords and people renting out rooms in their home. His credit would be toast. You are trying to be the good guy here and save him this black mark on his credit, therefore he needs to leave within the next 30 days.

    If you get another roommate, you seriously need to write up a Roommate Agreement.  There is one in my Roommate Survival Guide, you should be able to find several on line and a few in the library.  DO NOT have roommates without signing this document."

  5. You need to Confront her right now and tell her the truth you shouldn't hesitate at all. Tell her she need the pay the rest because it's the fact she agreed to live there and must pay her expenses.  

  6. You should tell her to give you the money or she can not live there anymore!

  7. If she is normally not late than I would make it a point to let her know that you need the rent asap.  Start running an ad in the newspaper for another roommate.
