My roommate moved out 6 months ago and left his bed. do i have a right to sell it w/o him pressing charges?

i have been asking him to come and get it for months now and he always has excuses why he cant come and get it. i own the home so does the bed become my possession?

  1. You will need to check with your local "landlord/tenant" laws. In most cases, you put it in writing giving him/her 30 days. After that, they can take you to court, but you have proof that you gave notice.


  2. If you have proof of his date of leaving the premises and it is over 90 days, you can dispose of the property. but to be sure send to him a certified letter (with copies made by you) signed receipt, that you intend to dispose of his/her property with-in 10 days.If not picked up, it will be disposed on day 11, then you can proceed as you wish.

  3. Check with your state's abandonment laws.  I would send him a certified 10 day letter telling him he has 10 ten days to pick it up or it will be disposed of (whether you sell it or otherwise).  In my state, 6 months would be abandonment and you'd be able to get rid of it.
