My roommate signed a lease and moved out after 3 months and our lease is 15 is she still responsible for rent?

My roommate left within three months of us moving in if I were to get evicted is she legally responsible as well for her part of the rent

  1. if her name is on the lease and the only one, she is liable, if her name is on the lease with others she is liable for her share, for the length of time it takes you to find another tenant


  2. absolutely. You are both responsible for the rent. You both signed the lease. It is a legally binding contract. My suggestion is to find someone else to move in and help cover their portion of the rent and go after your former roomie in small claims court for the months that you had to pay all of the rent yourself. Also- be sure to keep your landlord in the know of what is going on. They may be willing to tear up the old lease and give you new one to finish out the remainder of you current lease, in the event you are able to find a new roommate.  From the landlord's perspective, as long as the rent is paid, who cares. However, both of your names will be on the CRP (Certificate of Rent Paid) and you will lose out on even more money. Don't just let this slide.....15 months is a long, long time!!!!

  3. If you get evicted, yes she will be responsible for her part of the leftover lease.  example:  you have 3  people,   each of u will be responsible for 33% of the leftover lease if you break it (get evicted)

    The sucky part is, if you decide to stay, you are still responsible for the FULL rent each month .

    You are both responsible to the landlord for the full amount of the rent.

    If she moved out, you are responsible to pay the full rent.

    You must mitigate your damages by attempting to find a replacement roommate, with the landlord's approval.

    Once a replacement roommate is found, you can sue the ex-roommate for her portion of the rent for the time in between her moving out and a replacement moving in.

    If you fail to pay, you would both get an eviction judgment against you.

    The landlord can go after either of you or both of you for the rent until a replacement tenant is found, as well as other costs incurred due to the breach.
