Question:

My roommate signed the lease but I didn't?

On the lease my name is stated but I didn't sign it. My roommate did and so did the apartment manager. Is he held responsible for the apartment even though I didn't sign? Am I responsible since my name is on the lease but I did not sign? It just doesn't seem like the paperwork should be official unless I sign it but the apartment manager is saying it is. Thanks!

  1. just sign it.  not a big deal.  it looks sketchy if you don't.

  2. You are a subtenant of the primary tenant. If the landlord chooses to evict, your name will be on the paperwork but if he has to sue, he'll sue your friend - who then, in turn, can sue you as the agreement is between the friend and yourself and not the landlord and you.

  3. Your roommate and the LL are bound because they signed. . . . you didn't sign and aren't bound. . .hope you're not a jerk to your roomie. . . .you were intended to be part of lease, but you didn't sign and you aren't officially a tenant

management should know better and ask you to come sign the lease

  4. The lease is binding for the signed parties. You are not bound to the lease.

  5. Depends on where you live, different states different laws. Contact a local tenant organization or lawyer and ask.
