My sister-in-law wants to give us custody of her daughter, can she legally do that?

Father is in jail and she cant take care of her. She starts school this year and i don't want any issues. We pretty much have her all the time anyways. Her mom only sees her on the weekends.Her choice not ours. Its a sad situation.

  1. if a judge ok's it

    otherwise who sign for her in the emergency room

    if she does it legally

    you can authorize school documents, and scolorship info

    It has to be written and notarized


  2. Yes  you have to go through the court system to have this done.  but usually if you are proven to be fit parents then this will be a pretty smooth process.

  3. yes she can do that and make sure u get a black and white letter from the authorised, saying that u are  the gurdian and full custody is given to u ...... this is to make sure that u wont be in trouble in future...

    cos in future they might take back the child once she grown up...



    (this is what im going true now... its really hurt & im not allowed to see the child) so pls act smart  

  4. Does she have legal custody of the child?  Where's Dad?  Generally speaking, Dad's next in line for custody if Mom doesn't want custody.

    EDITED TO ADD THIS AFTER YOU ADDED ADDITIONAL INFORMATION:

    Since Dad's in jail (and assuming he'll remain there for some time) he can't contest it (actually he can, if for example, you're unfit, but I assume that's not the case), so yes, Mom can sign over custody to you, but it needs to be legally done.  Make an appointment with an attorney.

  5. she can go to court by filling a custody motion for you to be guardians of her daugther..do the paperwork and the judge signs the papers..work out the visitation arrangement and all right there in court
