What does she need to be able to come into the U.S. with her kids?

  1. If her children are under 18 then they can receive American passports.

    A foreign-born child has a claim to U.S. citizenship if he/she was born

    after February 28,1983 and is under age 18 when all of the following

    conditions are met.

    At least one parent is a naturalized U.S. Citizen

    and

    The child is residing in the U.S. in the legal and physical custody of

    the U.S. citizen parent(s), pursuant to lawful admission for permanent

    residence.

    You will need to present the following documentation when executing

    these applications:

    1. Child's foreign birth certificate (with official translation, if

    necessary)

    2. Parent's evidence of U.S. Citizenship

    3. Child's evidence of lawful admission (foreign passport with INS Stamp

    I-551 or Permanent Alien Resident Card)

    4. Parents' Marriage Certificate, if applicable

    5. Parents' Certified Divorce, Separation, or Legal Custody Decree, if

    applicable

    Naturally, if you prefer, you may submit a Certificate of Citizenship in

    lieu of the above documents.


  2. How did she become a US citizen and when? How long did she live here and at what ages? The kids may need to get registered as births abroad and get passports.

  3. She can either get her kids registered as births abroad and get American passports or if she does not want them to have choices then just get Canadian passports and bring them on.

  4. I assume you mean to visit.

    By land, she just needs government issued photo ID for herself and brith certificates all around.  Depending on the age of the kids if they have any photo ID, she should take that too.  A letter from the kids father saying she has his permission to travel with the kids would be a good plan and it doesn't cost much to get it notarized.  She should be prepared to say exactly where she is going and for how long.

    If flying - passports for all and again the notarized letter if the kids father is not traveling with them and round trip tickets.

    Get the passports, you will soon need them.
