My sister was involved in a car accident while driving my car. What can i do?

My sister and my daughter were pulling into the gas station to pump gas when this lady on the left side of her backed her car into my car. Police got there but did not make any report. after exchanging info and taking pictures. i get a call from the ladies insurance stating that my sister hit her. now its her word against ours. what can i do?

  1. 1.always demand police report....2..if she was backing up its her fault no if ands or buts...3..tell insurance co everything u know...witnesses if u can find them...forget it and let them do the work/worrying...

  3. Have they got cctv at the gas station, because if they do and I think they would, it will show the whole thing. Then sue the pants off of the old bag.

  4. You need to contact your insurance company and make a claim so they can defend you.  They don't want to pay out on a claim if they don't have to, so they will investigate what happened by getting statements from both drivers and work with the other company to determine fault.

    If they cannot determine fault then you will have to pay your collision deductible to get your car fixed.

  5. If the damage is on the SIDE of your car then it should be pretty clear that the other vehicle hit you (as cars do not move sidewides).  Ultimately, I would submit your claim to YOUR insurance company and give a statement to your claims adjuster as to the facts of the case.  They will then take that statement and pictures of the damage and pursue the other lady's insurance to collect if it is deemed her fault.
