My son got arrested for assault with deadly weapon and vandalism he has no prior record is he going to jail?

this was his first time ever getting in trouble unfortunatly he actually didnt have a weapon it was his friend but the mistake that my son did was giving him a ride home

  2. Depends where you are.  In Scotland, he definitely would not get jailed, in fact he would probably walk away from court without conviction.  That is how it seems to go here.

  3. You have a ton of issues you didn't address.  1) Is he a juvenile or adult? 2) What were the facts? 3) Do you actually know the charges or just what your son is telling you what the cop said? 4) What other goals and ambitions does your son have?  5) What state was this in?

    Honestly, going to jail is not the only concern here.  You really need to sit down and think a minute about all the potential consequences.  Assault with a deadly weapon, in California, is a 245.  That's a strike.  Vandalism is a misdemeanor or felony depending on how much damage was done.  Were there gang issues?  What kind of weapon are we talking about?  Who was the victim?  Was the victim injured?  Is there a confession from your son or his friend?  How much do the police actually know?  Does your son have a goal to work in law enforcement?  How high is the bail?  Is there bail?

    The way you describe it, the DA could have a rock solid case for your son and his friend conspiring to shoot at someone and ending up hitting a house, for example.  Or, this could be your son's friend chasing some other idiot with a rolling pin where no one got hurt.  Or, the DA could have virtually no evidence and the cop was just pulling your sons chain.  On the one hand, you're talking prison, on the other, you're talking a misdemeanor or potential dismissal.  From your question, no one can have any idea about the "value" of the case because the "value" of a case is determined by the facts.  Calm down, you are gushing and not thinking.

  4. Without knowing your son's age and the circumstances, where you live or what exactly happened, there is no way that you can get an honest answer.

    Many people are going to respond with their hopes and beliefs but without more information, I wouldn't bank on any answer being accurate.

    He should not have been hanging around anyone with a weapon (or anyone who is the type of person to have a weapon).  And if he is being arrested for assault, it means he (or his friend and him) was USING the weapon.  And they were vandalizing something too.  

    Stop making excuses for your kid, or believing everything he says.  If he was brought up correctly, he would not have been hanging out with the wrong crowd, or even a part of the wrong crowd.   This whole situation stems from parenting.  I'm sorry to be so blunt. But I had a innocent family member killed by some thug kids who were being stupid with a gun.  I hope you step up and teach your kid a lesson.

  6. Does your son have an attorney?  Then ask HIM.  If your son does NOT have an attorney, you can bet your bottom dollar that he is going to jail AND paying fines.

  7. It is hard to tell from your question.  Giving his friend a ride home could result in a charge for POSSESSING a weapon.  In order for anyone to be charged with ASSAULT, something more had to happen.  We need to know what that was to give a reasonable answer.

  10. How old is your son? More likely than not, he'll end up with jail time. Sorry! Hopefully it will teach him a lesson ...?

  11. He probably will for less than 6 months. Maybe he will not do this again. He needs a good attorney.

  12. If his Friend can convince his attorney that he had nothing to with  the crime then charges could be dropped altogether..the question is was he accused by the victim? And will his friend admit he did commit a crime to exonerate your son.

    This is one way your son to see who is real friends.

    But yea I would say he may see some jail time depending on the extent of the injury and circumstance.
