My son got hit by a car help?

my son got hit by a car last year and the insurance of the guy is offering to pay $25000 for the accident but the medical bill is $60000 and the insurance offer cannot cover it? i want to know how i can get more than $60000 from the insurance because my lawyer is not working hard enough. and my credit is getting messed up really bad.

  2. What Lawnboy and Luna said... plus, if you have to come here to get your question answered, your attorney is not working for his/her money. On that note, your attorney is going to take 1/3 of that $25k, lowing the amount your going to receive even more.

  3. Tell your lawyer to tell the company that you will take them to court. I would start the filing process immediately. Show them you are serious. Also, if your lawyer is not as aggressive as you need him/her to be, you can report their misconduct at the State Bar.

  4. Either, the $25k was the other party's liability limits, or your son's own comparative negligence reduced the value of the claim.  

    You need to speak with your attorney.   If you have underinsured motorist coverage, he should be filing a claim against your UIM coverage.

    Edit - They do not HAVE to pay your medicals if they exceed the liability limits.  Also, your attorney will not sue the insurance company, he will sue the owner/driver.

  5. They HAVE to pay your medical bills.  An insurance company will try to get away with giving you as little as possible, you have to stick it to them.  If your lawyer is not getting things done then you should definitely get a new one.

  6. You can also fire your attorney & get one that will be more aggressive.

    The insurance companies are going to try to settle for as few dollars out of their pocket as possible. And not having an attorney that is wanting to go after the ins co isn't helping.
