My son got into a car wreck a few months back, we contacted a attorney, they had him sign some papers.?

the insurance company offered the full liability of $100,000. with a $10,000, medical. the lawyers wrote to the insurance company and told them not to cut the check until they hear from them. they said there might be possible lien's. (doctor bills) as of yet the only thing my son has seen from the lawyer was the letter telling them to hold the payment and a letter to the insurance company that they would be representing my son. we have not seen any lien documents. my questions is, is the liability money for medical bills and can the lawyers pay it all away as their obligations. this is what he is telling my son. that he is obligated to pay the liens. in his letter he wrote, quote, "there will be liens"

  1. Likely YOU won't be seeing any lein documents.  Only the lawyer will.  

    Yes, the liability money INCLUDES paying back your insurance company - health or auto - for medical bills.    Yes, he's required to pay it.  

    Figure, that $110,000, then subtract out the lawyer's share - usually 30%, minus the medical costs, which means paying back your health insurance, and your car insurance for what it paid out on your behalf, and any other unpaid medical costs,  and your son actually gets whatever is left over.  IF there is any left over.  If he had huge medical bills, he could still end up owing money to doctors/hospitals.


  2. Here's the short answer -- your lawyer will take the settlement amount - subtract the money for the doctors/medical providers and pay them.

    He will then take the remaining amount - subtract his fee (usually 33%). It will be outlined in the retainer that your son signed when you hired the attorney.

    Your son gets what's left.

    You really should ask your attorney these questions -- that's what you pay him for.
