My son is in Special Ed and he happen to hit his classmate in the ear, am I responsible for the med exp?

My son has behavior problem, fine motor & speech problem. He hits his (during class) classmate and accidentally landed in the ear. Acc to the teacher, the ear bleed. Am I responsible for the medical exp of the classmate? P

  1. I would ask the school what the policy is. If you can afford it and the injury is bad, I would offer to help with their co-pay. Do you know if he had to go to the doctor or did the school nurse just look at it?


  2. The injury is probobly not that bad and you should take responsibility for it say you're sorry but explain to the child's parents of how tough it is for you and how tthere is really nothing you can do to change it.

  3. Yes, you are liable for the actions of your child.  you may be able to have the school take responsiblity also if the teacher was somehow negligent.

  6. It might be a good idea to contact the parents of the other child, keeping in mind that they, like you, are parents of a similarly situated Special Ed child and will probably have the same kinds of concerns that you have had the shoe been on the other foot.

    You can then ask them directly about the medical situation.

  7. No your are responsilbe for medical expenses. The school is at fault  for not providing your child with the supports needed so he can learn to express himself appropriately.

    I recommend you request a Behavioral Intervention Plan for your son, so he can learn appropriate replacement behaviors.

  8. I would apologize and see how serious the injury is. If the teacher says its an accident then that is where I would leave it as she was there and you and the other parent weren't. I would also have your son apologize for hitting his friend. We do that with my son who has autism and he is just starting to figure out that these things hurt our friends.
