My sons being bullied, what are my legal rights as a parent to stop this?

My son continually gets bullied by the same kid and today my son got bug spray sprayed in his eyes at school. What legal actions as a parent do I have? This has to stop and the bully's mom is no help at all and almost thinks this is normal 9 yr. old behavior. Help, thanks.

  1. just keep your son spirit high, talk to the principle, show your son self defense?

  4. I'm not sure what legal action you can take since it happened on school grounds, but did the principal do anything? Did he suspend the bully?

    You can talk to your lawyer see what your rights are. I agree, it has to stop, not just with your sons situation, but every bully needs to be stopped and the schools should be more involved.

  5. Bring it to the attention of the administrators and see if they can do anything about it. If the school has competent admins it should be handled all right.

Talk to your son first and see how he feels about you becoming involved, if he is happy with your involvement then go to the principal of the school, request a meeting set up with you, the principal and the parents of the bullie. If nothing is solved contact police and file a complaint against the child. Still nothing then seek legal action. Find out the schools stance on Bullie's. If there is no action set up ask why and attend parent teacher meetings to implement a system

  7. You need to keep on contacting the school about it. My nephew was badly bullied at school and part of the problem was that the school didn't seem to be taking it seriously.

    My sister kept on complaining about it and eventually she contacted some other parents whose children were being bullied and felt the school wasn't taking action and they all went and complained together. that finally got results.

    I hope the situation gets better. It can be hard when the parents don't think their child is doing wrong because how can a child be expected to behave if they have no guidelines. I think in this case especially it sounds like the school will need to take action if the mother wont, and for that to happen you need to put pressure on the school.

  9. this happened to me.  what u do is talk to the school or the headmaster or any one.  Try to find someone that is the a main person.  use your sons name so when they call the bully in he will stay away.  He might get a little mad at him and annoy him a little but he will bak off.  I hate bullies!

  12. At this time, I do not think there are any federal statutes that deal with Bullying in person...cyberbullying is a different story. I would recommend talking with the school. Which I am sure you have done. Sometimes this is no avail. I would also recommend you fill out a police report and contact your local juvenile office. This incident with the bug spray, could actually be classified as assualt.

  13. Your school probably has an anti-bullying policy.  Look in your parent handbook if they gave you one or call the school (or superintendant's office if the school is a problem) and ask.  If it is happening outside of school talk to your local police department and see  what they can do.

  14. As a parent you have all sorts of legal rights to protect your children from harm. While they are in school, you are transferring that authority to the school administrators to protect your children. Go to the school & speak with the principal. If you aren't getting any satisfaction at the school level, go to the Board of Education & file a complaint with them. Continue doing that all the way to the state BOE if needed. If I were placed in your position, I'd get Child Services or the police involved IF the school did nothing to curtail the bullying & discipline the other child(ren). Since you stated that your child had bug spray sprayed into his eyes, I'd get on the principal ASAP to curtail this before this escalates & something more serious happens.

  17. check you local laws to see at what age a child can be arrested.Here in Texas a 10 year old can be arrested.File charges if they are old enough !

  18. If someone sprayed bug spray in my kid's eyes I would call the police. That's dangerous and it's assault. If the school won't do anything, and the kid's parents won't do anything, you need to call the cops. Your child has a right not to be assaulted.

  19. bullying is a federal offence, you can sue if you want to take it that far.  take it to the school and ask for their advice on the matter, if it happens in school then it is the teacher's responsibility to take action and put a stop to this since he/she is responsible for the children during school hours

  20. The bulliers mom doesn't think there is anything wrong because she hasn't been on the other end of it......yet.  You have to go to the school. the school board, the PTA, etc.. The squeaky wheel gets the oil and when it comes to your child you gotta be loud.
