Question:

My sons roommate threw his personal belongings out can he get out of his lease?

his roommate will not sign him off the lease so even though my son as moved out of state he left some boxes in his old room since he is still on the lease but his roommate threw it out to make room for a roommate . Is he now legally able to get his name removed from the lease?

  1. No. These are 2 separate issues. He can sue the guy who threw out his things but his lease is with the landlord and has nothing to do with it.


  2. No, not unless the landlord will let him out, or he pays off the balance of his lease.  He signed a contract, which is his lease.  Lesson learned the hardway, sorry.

  3. Only if the landlord approves.  On the other hand, he has every right to move back into the apartment and have the new person evicted.

    To make things easier, I would sit down with the landlord and the ex-roommate and make arrangements to switch names.  Until he does, if his name is on the lease, he is still responsible for the rent.

  4. While I agree if your Son's name is ON the Lease, he is Responsible but, throwing out his Personal Belongings is a 'no-no'!

    However 'if' the other Guy is bringing in a NEW RENTER....he has no right to unless he clears it with the Landlord, signs a NEW Lease with NEW Renter and takes your Son's name off the Current Lease.

    You never mentioned if your Son stopped paying Rent and just 'left'!
