My soon to be ex-spouse filled my pain med prescription illegally, can they prosecute, what can be done?

I recently found out that my soon to be ex-spouse illegally filled 2 refills of my pain medication. They are addicted to prescription meds. When I went to get a refill, I was told it had been refilled. The pharmacy let them get the meds without written consent or signing for them. It has been approx 3 months since this happened and I would like to know the following:

1. What is the statue of limitations of this kind of crime?

2. Can they be arrested and prosecuted for this?

  1. You need to call your lawyer and ask to have this taken care of. It's a lawyer's job. Keep safe!


  2. You don't have to 'sign' for them. All you have to do is know the patient's birthday. Unfortunately for you, that is. The pharmacy CAN put a block on anyone who picks them up now, if you tell them to accept only on picture ID.

    You'd have to have proof that they didn't deliver them to you, and it's your word against theirs. Why did you wait 3 months?

    You can tell the police, sure, but again, they can say you asked them to, that YOU are addicted, and are just trying to get more.

  3. Yes, they can be prosecuted and I'm sure the statute of limitations is much longer than a few months.  It's a serious felony. Do you have proof, or could it backfire onto you? proceed with caution.

  4. She's not your ex yet, so I'm pretty sure she's legally allowed to pick up your refills.

    You need to let your pharmacy and your doctor know that she is not allowed to pick up any medications on your behalf.
