My tenancy ran out in july and my landlord hasn't got me to sign for another 6 months can i leave anytime now?

my tenancy ran out 17th july, our landlord hasn't said anything about signing for another six months, are we automaticly tied to our home for another 6 months or can we hand in a months notice and get out of here please help me x

  1. OK - you don't say were you are but in most states a lease automatically goes to a month to month when the initial lease term is up.

    So yes - you can give 30 days notice and move out.

    2. In most states it goes to month to month with a thirty notice to move needed given on the first day of the new rental month.

  3. Hi after your six month fixed term, you will automatically go to a "statutory periodic tenancy". Nothing changes, except you are not tied into a set period, as before. All you have to do to vacate is give the landlord 1 months written notice. Check in your agreement, it may say that the notice must be from a rent date. Which means 18th of the month when your agreement started.

    If I were you, I would give a months written notice in writing, then if there is a rent date period for notice, you can withdraw that one and give him notice for the rent date, well before the last day, then he can not say he did not get it.

    Find your state's laws on residential leasing: what do they say? Just search Google for your state's name anbd the words residential tenant rights and you should come up with something.  

  5. whatever time you signed the lease for you are obligated to fulfill, after that you become month to month and then you have the option of staying on month to month, leaving after 30 day notice or resigning another long/short term lease unless your agreement states otherwise.

  8. In PA you would renew with the conditions of the lease being the same. Some say you can leave with 30 days notice. Some say 60, read yours.
