My tenant is using the garage as a recycling center. What should I do?

  1. Tell him straight that you don't want it in the garage, he can recycle as it is good to do so, but not to use your garage as a center for it, don't you have separate bins for that sort of thing, or a recycle center near you, where he could put it.


  2. Let your tenant know that you need to do a visual inspection to be sure he is using proper containers for what's being recycled and if not give him x # of days to comply with it and come back and inspect again in 30 days or so if it is not done evict.

The first thing I'd do is check on the l.aw and find out if what he is doing is legal.  If so, you as landlord can stipulate rules in the contract for future tenants but check with a lawyer to make sure it is legal.  If the tenant is breaking the law then you have a course of action through the law.

If it is not against the city codes..It will do no good to call authorities....If you can visibly seeing that he is damaging the garage, and not just simply utilizing it, then you may have a cuase of action to ask him to stop...This does not mean you can simply walk in while he is gone and trespass to do so..this is illegal..no matter if you own the property or not..if he leaves the garage door open and you go up when he is gone..you can walk as far as the entry of the garage and do a visual check..again..do not enter the garage..You have no right too unless you give a 24 hour notice unless you see a situation such as a fire or flodding water etc...If you see visible damage, then you can send him a registered letter requesting that items need to be removed so you can do repairs..repairs he will be responsible for if due to his recycling...If your lease states he has no usage of the garage(which i doubt)...You have a stand there..He is not considered running a commercial application on a residential property, for recycling is common in many many homes..regardless if he sells his salvage..If no visible damage, and the other mentioned above do apply /or do not apply..about all you can do is wait untill he moves and hold back the deposit untill there is any damage substained corrected and deducted from his deposit..keep in mind "normal ware and tear" does not constitute retaining a deposit..
