Why don't you ask her and find out?  I can't imagine what else she'd be petitioning about, but if he left a will and it's a valid one there's not much she can do to contest it.  Is she his daughter or another neice?  As his daughter she might have a little more sway, but as another cousin...I doubt she'll get anywhere with it.
