  1. It sounds like it could be a transmission problem. 40mph is about when an automatic transmission will go into over-drive or its highest drive gear (varies with every car, but 40 mph is possible).

check the transmission fluid. If its not a bright red color then have it flushed (be sure to have the filter replaced also). If the color is good but the fluid level is low, then add some fluid.

  2. When say  foot down do u mean gas pedal  all the way to the floor? If so you might be experiencing normal down shifting from the transmission. When going at a steady 40mph and then a abrupt change in throttle position to the floor will cause the transmission to down shift to appropriate gear base on how fast the car is going and the angle of throttle position sensor. ..Also your car's model is the high performance package and that can also make a difference in the way it shifts compared to a S70 turbo.I  suggest having a reputable independent Volvo repair shop to verify if it's an engine performance or a transmssion performance problem. The cost of diagnosing the problem shouldn't hurt your pocket book.It should take no more than an hour of to determine if it's trans. or engine related.

  3. Check spark plugs  - they are due for replacement every 30,000 miles.
