I live in an apartment complex where the parking is well.. horrible! The parking space's are sooo tiny that its hard to not hit the person next to you's car. Well needless to say My car was damaged by my neighbor's car.. I have 2 big scratches/ding's on the side of my car that are red and blue .. the colors of both the neighbor's car's. I also have a HUGE scrape down by the back bumper of my car that you can clearly see was from a kid's bicycle handlebar's. I do not have renters insurace.. Am I going to end up paying for this or can I bring it to my landlord and make him pay for it?? I really dont have the money to get this fixed on my car and its a 2004 so I also dont want it all dinged up when I'm paying so much money for it! any suggestions?? Thank you!!!

  1. The landlord doesn't have to pay for damage someone else did.

Having a car is a choice, and to park it there is a choice.

Do you not have insurance?  You should.

  2. This would not be covered by renters insurance even if you had it.

You need to file your claim with your auto insurance company.

The landlord is not involved and there is no way to "make him pay for it", it is none of his business actually.   This is your car, not his.

  3. Talk to your neighbors after you take pictures of everything including their cars showing proof they are also damaged. Someones insurance should pay for this!

  4. First off, you should have renter's insurance for your possessions in your unit. If there is ever damage to your property, you will be similarly wailing that the landlord should pay for it.  That is YOUR responsibility, as is the damage to your car.  It's not the landlord's fault that others ding and nick your car.

If you cannot get payment from those who caused the damages, then you need to contact your car insurer for help.

  5. SORRY- but landlords are NOT resposible for damage to your personal property and most leases state that even if its in the small print nobody bothers to read.

  6. That is why you have automobile insurance.

  7. Why do you think the landlord should be responsible for your damages?   Sue the neighbor who hit your car or make a claim with your auto insurance.
