My wife go to USA, but she is using her maiden name, she is legally married to me?

after 7 years she got married to another man, but she never file an divorce or annulment. we have 1 child that she abandon for 9 years. can i file a complain to the embassy for legal action. i have a copy of our marriage certificate and my daugther birth certificate.

just leave it be you have a child to worry about and that is the only thing that matters. Forgive and forget as this person is no longer your concern. Get on with living a happier life and setting an example for the child.

Why did you wait so long?  Regardless, you should contact the US embassy where she applied for her visa.  Either she made a false statement of a material nature saying that she was never married, or she supplied false certificates and made false statements of a material nature to show that you were dead or divorced from her.  Either way, her status in the US is subject to revocation and she is amenable to deportation.

If there was no divorce then she is still married to you. The embassy has better things to do than deal with this issue. Contact a lawyer if you need help. Just because she went to the USA does not mean she broke the law. Using your madien name is not legal - not all married woman take their husbands name.
