Question:

My wife is a foreign national on a visitors B1-2 Visa in the U.S. She would like to exhaust her 6 month limit

(multiple entry) this trip and "step out" into Canada and then return for another entry to the U.S. under the same visa category, B-2, visitor for how ever many months the entry officer allows. Is this feasible, or does she have to go all the way back to her home country (Philippines) ? I know that if she files for an "extension", it would not be guaranteed accepted, and would cost almost $400 to file. Any other options?

  1. No, that dog won't hunt.  The CBP Officer will immediately see what's going on (she's trying to live in the US on a tourist visa) and refuse to admit her back into the USA.  Then, the next time she tries she'll get a very hard time because there will be a notation in her file that she was refused entry.
