My wife is in the IRR and she got orders for IRAQ and doesn't want to leave our family, will she go to jail?

She is due to come home in November after being a civilian contractor for a year for KBR in IRAQ

  1. Oh,she can go for Civilian Pay...but can't go for Army Pay...??

    That is what your question amounts to...

    Tough sh*t...tell her to pack her bags.

    Or go to Jail...There is no reason she can't go.

    She proved that point by working for KBR...

    LMAO...I just bet she will be doing almost the same

    job for Military Pay as she was doing for Civilian pay...

  2. Yes, she'll go to jail. In fact, it'll mess up her entire life. Hey... when she goes back over, maybe she'll see some of her KBR buddies... =P

  3. Yes she will and she should.be...She signed the contract, no one forced her to..

    She will be activated first so she then can be prosecuted like a active member who is refusing a lawful order.

  4. I have not heard of any IRR people being recalled.  They aren't even using all of the guard/reservist.  This just doesn't make sense to me.  

    If by chance she was recalled and did receive orders to Iraq then yes she has to go.

If she has signed her papers and taken the oath of enlistment, and then fails to show up when called, she could be tried in a court martial for violation of Articles 85 and 86 of the Uniform Code of Military Justice.  Jail would be the least of her worries -- how would she feel, as a convicted felon, about losing her right to vote?  Any chance at any Federal or State job?

  6. she is REQUIRED to report.    not the military's fault she took a civilian contractor job and has been gone.  

  7. I believe she will have to serve a jail sentence because they would consider the desertion.

  8. IRR is part of the deal.... you are ready. Plus most people don't realize that in the fine print it says that you may be called back even after your IRR obligation has ended.

    Sure jail and all of that are in the cards just as if she was active. If she is a no show the military might eventually let it go but her discharge may be modified. If she has recieved orders she has to go. The military may bring some super serious charges other than the discharge thing.

    No show will mean that she can hang up government contract work clearances and all of that. It will mean that even if she goes to a company that does non defence work she will be done as well. Basically she would be screwed forever.
