Dear sir

My wife went to us on F1 last month she came and got pregnant and she went back, what are the documents required for F2, what is the status of my son in US.

  1. you didn't state where the child was born.  I will assume that your wife gave birth in the US and under the US constitutiion, that child is a US citizen.


  2. if you think the us govt will then change your status and let mom stay no way. the child cannot anchor you nor can the baby sponsor you to stay permantly. the child cannot until it is 18 yrs old. not only that your nation may not recognize it either.

  3. How clever!  By US law, your child will be a US citizen if born in the United States.  Therefore, the child will not require a visa, so F2 does not apply.  If you wish to join her, you will need the following documents:  A copy of her I-20, your own dependent I-20 linked to hers, a DS-156, possibly a DS-157, and a valid passport.  The documents will allow you to apply for an F2 visa - you will need to qualify for the visa on your own merits.
