My wife struck an uninsured motorists who failed to yield from a stop sign. What can I do to get my money?

My wife struck a vehicle who failed to yield from a stop sign. The dirt bag driver didn't have insurance, and was suspended. The owner of the vehicle (dirt bag #2 Passenger) didn't have insurance either, and she was cited for wrongful entrustment. The driver was cited for failure to yield and driving under suspension.

My insurance is stuck with paying for my damages, and well as hospital bills. I have tried to get in contact with the driver of the other vehicle, but he does not answer his phone.

What should I do? I am paying a 500.00 deductible, and this goes against my insurance as a claim. As well as lost wages from my wife missing work. Please Help!!

  1. Have your insurance company go after them for restitution.


  2. You can always sue, however most people, who don't have insurance, also don't have money or property. In that case you get a judgement against them which is a piece of paper worth about as much as the paper hanging beside your commode. Plus you'll have the lawyer and court costs. Not a pretty picture but, unfortunately, that's the way it is.

  3. Its up to your insurance company to recover the funds payable for the car repairs from them. Thats why you pay insurance, so you dont need to worry about those things.

    You need to file a civil suit against them to recover your deductable and any other associated bills.

    Be sensible with it though, usually lost wages day wont be reimbursed.

  4. This is all a matter of civil litigation. You can either hire an attorney and sue the owner of the vehicle or try and represent yourself in small claims court.

  6. My husband has been hit twice in two years by uninsured motorists.

    The first time the girl didn't have an insurance card and was given a ticket and the prosecuting attorney went after her.  She had to pay for everything or go to jail.

    This year the man had an insurance card (he got the policy and only paid one month) so he didn't get a ticket.  We had to fill out a form and file.  The insurance company will be going after him.  If he doesn't take care of things his license can be suspended and possibly arrested.

    My advice to you is check with the police to see what form would need to be filed in your state.  As a last resort you can take him to small claims court (I don't want to unless I have to--it's much easier letting the insurance company and the prosecuting attorney take care of it!)
