i've been seperated from my wife 6years ago, i even signed a legal custodian aggreement for our son, now they migrated to Canada. Can i apply to Canada using a spouse visa hence we did not file a divorce nor annulment but only legal custodianship between our son.

  1. I was planning on sponsoring my spouse so I know a little bit.  She has to be willing to sponsor you - and with that comes paperwork for both you and her, and she needs to earn enough to support you (and be willing to).  You also need to prove that your relationship is genuine and continuing...

Your best bet would be to apply for work within Canada and have the company sponsor you.

  2. As far as I can find, Canada does not have a spouse visa that meets your particular conditions. I'd review http://www.cic.gc.ca/english/immigrate/s... very carefully.

  3. I think what you're referring to is a visa where your spouse needs to guarantee your subsistence for the visa period.  If she's not willing to do that, you won't be able to take up residence there for any length of time.

  4. no, you must be in a real marriage not separated for her to be able to sponsor you
