I have recently become a permanent resident to the US my son would like to move here in WV, I know that we must do this before he is 21, he will be 21 in October this year. My husband is a US Citizen, and my question is what forms do I need to have filled out for my son to come here, I have him down on my paper work from when I immigrated, and the officer told us to do it before he is 21, but what papers do I need, Thank you to all who can help us

  1. Contact your nearest immigration office to find out what forms you will need and how to proceed.

  2. If you married before your son turned 18, your American husband would be able to file for him as his step father. However, if you married after he turned 18, you would have to file your own petition for him in the F2a family preference category. However, those petitions take 5 years before they are valid for use and it would no longer be valid if he married while waiting for the petition. One of you needs to file an I-130 immigrant visa petition for him. Check out uscis.gov for more information and downloadable forms.
