  1. First question- Is he licenced in your state?  Was it a verbal or written contract?  Most states have a board for contractors.  Most states also require anyone acting as a sub contractor to be licenced in the state they are doing bus.  If they don't they may be subject to fines.  In my state a verbal contract is as binding as a written contract.  This is a classic problem reguardless. Solution: Find out if he is licenced. If he is contact your state licence board for contractors.  You can find out if he has had other complaints filed against him.  (usually can get the info online)  If he refuses your only choices are to take him to small claims court and file a complaint with the state board.  You may also contact your local building official.  In my locality, technically you have to get a building permit to perform the work.  If this is the case he could be subject to the penalties by your local building department.

  2. If you paid him up front your are a fool! Should have got a licensed contractor. Now you are being cheated.

  3. u shouldnt have paid him first and made him sing a contract

  4. Signed contract and no verbal agreements equal you win in court. If you have no signed agreement that's not good. Sorry for your bad experience.

  5. It is not unusual for a contractor to ask for upfront money. Most contracts are split into thirds. One third up front, one third when the job is a portion complete (usually half done) and the final third upon completion. If he has been doing a good job, showing up every day, keeping a clean work area and generally been a good contractor, then follow the above suggestion. I am surprised that you do not have a written contract that outlines how he is to be paid.If you do have a contract, then you must follow it. If you don't have a contract and he is not doing a good job or keeping your lot clean, then you may be in for a problem. If your gut says you made a mistake in hiring him, don't get yourself in any deeper. Fire him and hire a professional AND GET A CONTRACT.
