Question:

NJ DMV points versus Insurance Points?

I was involved in an accident 2 years ago that was not my fault. Last week, I tried to get motorcycle insurance, and they ran my license to see if I had any points. It came back that I had 3 points from that accident! They told me if I faxed them the police report which clearly states that I was not at fault (which it does), they can erase the points from my insurance. Is that only valid for that insurance company, or will those points be erased so that if I go to other insurance companies, those points will not be there? Also, I don't understand how I can have these points on my license for something that was not my fault. Is it possible that I can have 3 NJ DMV points in addition to the insurance points? Is it possible to get DMV points without being issued a ticket for a violation? Thanks!

  1. It is not possible to receive DMV points without a ticket.  It is possible to receive insurance points depending on your company and how their processor viewed the accident.  I had an accident that even though I was not cited and the cop said it was not my fault, the insurance company split the fault 70/30 and the check I got for repairs was 70% of the total estimate to fix and I got insurance points which raised my premium.  Insurance companies are in bed with each other and do not care about the people paying the premium, just the bottom line.
