Australia’s former fast bowler, Nathan Bracken, who retired from all forms of the game in 2011, is suing Cricket Australia for negligence over his career threatening knee injury, according to a report in the Sydney Morning Herald.
The Aussie ex-cricketer has accused the governing body, and their medical staff of failing to "investigate, diagnose and treat" the right-knee injury he sustained a day before Australia played a One-Day match against http://www.senore.com/Cricket/England-c56013 on January 9, 2007.
The former paceman has blamed the doctors and lead physiotherapist working for Cricket Australia for not being “competent” enough to advise and treat professional athletes. According to Bracken's statement of claim, the doctors and physio ought to have realised,
on the basis of MRI scans, that his knee required arthroscopic surgery.
However, in the months following his injury, they neglected to refer him to a specialist orthopaedic surgeon for a more detailed examination. Dr Simon Carter, who sent him for an MRI, failed to diagnose anything but bone bruising. In addition, the team physio
http://www.senore.com/Cricket/Alex-Kountouris-c43123 and the team doctor Trefor James simply prescribed an analgesic and an anti-inflammatory drug, after which Bracken was declared fit to play.
Due to his continuing exertions on the cricket field, the 34-year old says he developed a "lunge lesion" in his right knee, followed by "constant debilitating right knee pain". As a result, the left-arm bowler quit professional cricket in 2010, and retired
officially in 2011, whereas a knee arthroscopy could have enabled him to continue playing well into 2015.
The case will return to court on March 2, 2012 and lawyers for CA and the medical staff in question are gearing up for defence.
"Lawyers for Cricket Australia and their doctors and physio are defending the allegations. The case, yet to go to hearing, was mentioned in the Supreme Court. Bracken was ordered to declare the size of damages he wants Cricket Australia to pay by February
22 and provide more details of his injuries," the Sydney Morning Herald reported. The Central Coast-based athlete will be seeking $1 million in lost earnings.
Bracken’s most prominent achievements include being declared the world’s best ODI bowler in 2008, and a 6th position ranking on Australia’s list of Most ODI Wickets, with 174 scalps to his name.
